On Saturday 9 May almost 500 people joined the four libraries march across Barnet.

Children’s Author Alan Gibbons started the march off from South Friern Library with a rousing speech.

As the march weaved in and out of the streets marching to the beat of a big bass drum it was amazing to hear the fantastic reaction from the public.

At East Finchley Library we were entertained by an improvised children’s choir who sang their version of the “wheels on the bus go round and round” as a tribute to the mobile library service.

Then we were off to Church End Library where we were met by London Metropolitan Brass band and a Red Double Decker bus donated by the NUT and driven by their branch secretary.

After a brief break to visit the library we then marched off with the Brass band all the way to North Finchley Library.

Everyone was delighted to have taken part in such a positive event and gave a commitment to be ready for the next stage of the campaign.

UNISON members working for Your Choice Barnet (YCB) have agreed to escalate their strike action next week to three days, 25, 26 27 March.

This will make a total of 11 days of strike action since the dispute began. This is in a bid to reverse the harsh 9.5% pay cut imposed on them by their employer.

Tonight UNISON have submitted a report to the Adults & Safeguarding Committee urging them to end the dispute and restore stability for the service.

Our report is in response to a recently published damming inspection report by Care Quality Commission (CQC) which is being discussed at the Committee this evening.

UNISON report makes two simple recommendations:

1. Bring YCB services back in-house and secure properly funded and safe services for service users.

2. Failing bringing the services back in-house; enter negotiations with YCB to discuss a more sensible funding regime which will secure improved staff morale, a more permanent, committed and better trained workforce.

UNISON Branch Secretary John Burgess said: “Our report vindicates everything we said before the service was outsourced simply ‘you can’t make a profit out of social care without implications for service delivery.’ In this case we are talking about adults with disabilities some of whom have no one to speak for them. The CQC report was one element of YCB service, but it was the first area which was decimated by redundancies which resulted in an increase use of agency staff”

In February 2012 Barnet Council transferred Learning Disability and Physical and Sensory Impairment services for adults to a Local Authority Trading Company (LATC) called Your Choice Barnet (YCB). About 160 staff (145.6 Full Time Equivalents) in Adults services transferred to the LATC.

Following a restructure in 2013 and cuts to pay on shift allowances there are now only about 105 FTE working for YCB a 30% cut in staffing levels.

It is very important that all of our Barnet Council members read the following information as there has been an overpayment made by the Council and they are seeking to reclaim it by making a deduction from your salary for a period of four months starting in March 2015. Below is a statement from Barnet Council.

National Pay Award – Pay Adjustments

Following the national pay agreement at the end of 2014, we have been asked to make adjustments to your pay to ensure you receive the correct salary.

In June 2014, Capita were asked by the Council to apply an increase of 1% to the spine points with effect from 1st April 2014. This was based on the National Employers’ position that this was the final offer on the table in negotiations between employers and Trade Unions.  This increase was applied by the Council in good faith to help staff after a number of years of pay freezes and to apply what we expected to be the final position.

During the year, at a national level, the trade unions and employers were in protracted negotiations and eventually agreed to a 2.2% pay increase, applied from 1st January 2015, and not back-dated to April 2014 as expected.

This means that there is a difference in what has been paid to local government (green book) employees, and what should have been paid (for 9 months April 2014-December 2014). This will affect basic salaries and overtime payments.

We are therefore making adjustments to pay where an overpayment has been made. (Please note, had the 2.2% applied from April 2014 we would have been backdating the increase instead).  This is to ensure the correct pay, tax and pension contributions are made.

To do this, we are intending to make the deductions over the next 4 months, starting in March 2015, to avoid any significant impact by taking a single payment.  Any adjustments to tax, national insurance contributions and pension will be made automatically.

If the proposed repayment schedules will cause particularly hardship to individuals, the council will consider alternative proposals. Employees should agree these directly with their line manager who should notify the payroll team of the agreed arrangements.

The adjustment will appear as BAS PAY ARR T/S on the payslip.

a) National Pay negotiations

This is a quick recap on the history of the national pay negotiations. As all members will know UNISON campaigned against the 1% offer which is why we took strike action on 10 July last year.

Throughout the summer UNISON was campaigning to escalate the strike in October 2014. However a revised offer was put to our national negotiators and so we were asked by our negotiators to consult our members. Our branch officers looked at the offer and realised it was not a better offer and therefore advised our members to reject the offer. Our members overwhelmingly rejected the final offer. We passed this information on to our national negotiators, however, other UNISON members across the UK voted to accept the final offer.

b) UNISON Pay Conference 24 March 2015

I can report there has been serious concerns raised by a larger number of UNISON branches across the UK about the final offer which fails to deal with the ‘cost of living crisis’ being experienced by our members. As a result of this concern a Special UNISON Local Government Conference has been convened to talk solely about Pay on 24 March 2015. Our branch will provide feedback on the outcome of this conference.

Once we had the news that the revised offer had been agreed, Barnet UNISON immediately wrote to the Council seeking confirmation as to whether the Council would be looking to claim the money back. It wasn’t until January that we were first made aware the Council was seeking to reclaim the money back.

Over the last four weeks there have been a number of meetings about what is being reclaimed and when. Unfortunately school staff have been contacted by Capita HR Payroll before negotiations had been concluded. It is important that all of our members in schools are aware that they can re-negotiate the repayments.

c) How did this happen?

This is a frequently asked question. In the past Barnet Council has never paid the national pay offer whilst negotiations are still on-going. This meant that quite often negotiations were never agreed until September and subsequently all staff would receive a backdated amount in their October pay roll and their spinal point adjusted. As a result of paying early and the revised offer not starting until January 2015, the Council suddenly realised they had made an overpayment of nine months’ pay. As far as we know none of the contractors who are paying the revised national pay award made the payment earlier and so do not have any issues about reclaiming overpayments.  

d) Support for members.

We understand that for members these deductions will come as a surprise and may cause hardship.

It is therefore important that all members understand they have the right to re-negotiate the repayments. In the Council statement it states you should speak to your line manager in schools it may be your Head teacher.

National Pay Award update for TUPED ex Barnet Council staff

I have been contacted by ex-Council staff working for contractors who should have by now passed on the revised final offer. For any staff still unclear as to what they should have been paid, we have the national pay award, which we can provide, which explains:

1. The non- consolidated payment which should have been paid in December 2014

2. The new pay scales including the 2.2% from 1 January 2015.

I understand that some colleagues may have heard there have been problems with regards to the payment of the offer to the Council workforce. As far as I am aware this is specific only to Barnet Council staff. You can read about what has happened here.

UNISON members working for Your Choice Barnet (YCB) have just announced their next strike dates as being 24 & 25 February. This takes place in the middle of the TUC Fair Pay fortnight.

This will make a total of 8 days of strike action since the dispute began. This is in a bid to reverse the harsh 9.5% pay cut imposed on them by their employer.

YCB has not met with UNISON as they have indicated they have nothing new to offer. Barnet Council has failed to become involved in a positive way at all. The Council has clearly been giving preferential treatment to its private contractors with the news of Capita has already received £110 million in the first 16 months of the two contracts. If YCB were to receive this, it would carry on producing a service to the residents on the scale it does for the next 18 years with no pay cut to staff!

This dispute is clearly one of priorities.

UNISON Branch Secretary John Burgess said:

“The driving motivation for our members in this dispute is their fears about what is happening to the quality of services. Low pay in the care sector does not deliver high quality services. It does not appear to work for Capita, we are at a loss as to understand why this would work for care workers in YCB.”

UNISON members working for Your Choice Barnet (YCB) have just announced their next strike dates as being 22nd and 23rd January. In addition the workers will be attending an event in the House of Commons 28th January highlighting the conditions for workers in this sector (see link below). This will make a total of 6 days of strike action since the dispute began. This is in a bid to reverse the harsh 9.5% pay cut imposed on them by their employer.

UNISON and YCB have had numerous meetings at ACAS and there has been no improved offer which has come close to being acceptable to the majority of our colleagues. The latest offer made in October 2014, was a 7.9% pay cut and this was resoundingly rejected in a ballot of the membership. The discussions have, however, revealed stark issues imposed on YCB by Barnet Council which make it difficult to see how YCB can survive financially into the future without our members constantly bailing it out through their financial sacrifice. The pensions deficit (an extra 9.8% payment) for the TUPE’d staff was transferred across to YCB, although this did not happen with other contracts in the private sector. Relieving YCB of the pensions’ deficit would restore our members’ pay at one stroke. Not allowing YCB to charge for unplanned “no-shows” (when service users are unable to attend the service at short notice) would potentially halve the pay cut to our members. However, Barnet Council refuses to participate in any of our discussions although ultimately the Council holds the purse strings.

Meanwhile our members tell us they are working harder than ever with increasing levels of stress and no prospect of a pay rise. They report the first day they have off from work is used simply to recover from the stressful week they have had. The pay cut has left many of our colleagues finding it particularly hard to make ends meet.  They have made it clear to us they want to see a substantial shift in any new proposals from YCB in order to end the dispute.

“Our members held back from taking action before Christmas in order not to disrupt the service for service users and their carers at such a sensitive time of the year. This demonstrates again their professionalism and dedication but also their determination to stand up to attacks on their terms and conditions.”

What is TUPE?

What is TUPE?

The Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE) protects the rights of employees transferring to a new employer.

TUPE Transfer Commitments

On 16 January 2012 Barnet Council agreed what became known as the TUPE transfer commitments.(http://barnet.moderngov.co.uk/Data/General%20Functions%20Committee/201201162000/Agenda/Document%205.pdf)

However the Coalition Government has made some serious changes to the TUPE legislation which took effect from 31 January 2014. The changes have seriously eroded worker rights, making outsourcing a high risk option for Council staff. The key changes are as follows:

1. New employers will be able to renegotiate collectively agreed terms one year after the transfer, as long as the overall change does not leave employees worse off.

2. The new employer will only have to adopt the terms agreed between the previous employer and employee representatives up to the date of transfer. Anything agreed after this date will not apply to transferred employees.

3. A change in location of the workforce after a transfer will be allowed as an ETO reason, meaning that this can be used by the new employer as a reason for dismissal.

4. If agreed by the two employers transferring staff, any redundancy consultation that begins before the transfer can count as part of a collective redundancy consultation process with the new employer, as long as it is a meaningful consultation.

At a meeting with the Council on Thursday 4 December 2014, UNISON raised concern that the Council could progress to procurement shortly after the committee makes a decision on 12 January 2014. It was agreed that in the meeting that sufficient time would be allowed for negotiations for an updated TUPE commitments for any staff outsourced.

Location of the services.

UNISON has been in the unfortunate position of having to support members who were made redundant as a result of jobs being moved out of the London Borough of Barnet. It will be a key issue for us on this project that jobs must remain in Barnet and something we are raising now.

UNISON request for extension to public consultation on Libraries refused

Barnet UNISON earlier this week wrote to the Council expressing concern that the public’s access to the Library Review Consultation documents in the Libraries is being restricted.

At a meeting on the 16 October  2014 UNISON expressed concern about the current reliability of ICT in Libraries as this would hamper the availability of  documents for the public. At that meeting UNISON was assured that printed versions would be available  to cover this eventuality.

Our concerns have been borne out by events this week as UNISON has learnt that printed documents will not now be in the Libraries until the 1st December and there have been ICT issues!

UNISON noted Drop-in sessions are now taking place in the Libraries for the public. UNISON questioned the validity of the whole consultation process due to the lack of document provision.


In light of these facts UNISON requested an extension to the consultation period.

Our request was refused. 

2020 – A (not lot of) Library Space Odyssey –“Open the Library doors please HAL:” (Holographic Artificial Librarian)

Last Tuesday at a full Council Meeting it was voted by a majority of one to go ahead with the Libraries Strategy. Three options are to be offered for the future of libraries, but no matter which one is chosen the following results will apply.

Well before  2020  Barnet Libraries will have been replaced  by  a  number  of  libraries in the borough either run for profit by a private enterprise, or  by a mutual struggling to survive, or by community groups with insufficient resources.

Up to two in three library jobs will have gone. They will be replaced by volunteers and machines.

Most surviving libraries will   be smaller, being only 540 square feet in area. Book and audio-visual stock will be reduced, cutting choice. There will be less computers for the public to use and less study space available.

Libraries will be unsafe. For most of its’ opening times a library will not have any staff (or even volunteers) on site. Access will be gained through a swipe card. Unsocial behaviour and theft are not   unknown in libraries today despite staff being on site. The Council will replace on site staffing at these times by CCTV, and “remote voice or video information”.

These changes   will result in disaster for the service, and will discourage use by the public, increasing the likelihood of more closures in the years to come.

UNISON oppose the Library Strategy and call for its replacement with a plan for  that will benefit all those who have a stake a real Library Service.

Capita Re – redundancy consultation in Highways Services

On Monday 8 September 2014 UNISON members working for Capita Re Highways section were informed that statutory redundancy consultation would commence on 10 September 2014. Capita Re have carried out a review of the Highways function against the output specification that forms part of the contract with the London borough of Barnet.

The proposal was that they can make efficiencies by changing work practices and use of technology alongside the need to reduce costs circa £65k with a reduction in the Highways fee by Barnet Council as from July 2014.

Capita Re currently employs 284 staff.

The current staffing establishment for Highways is 23 staff and all of them have been issued at risk of redundancy letters.

The proposal seeks to make 10 redundancies and create six new posts. However, the six new posts are not redeployment opportunities for the staff at risk.

Over the past few weeks meetings have been taking place with staff as they are having to go through an interview selection process.

UNISON has requested some detailed financial information about the proposed shortfall in funding and expressed concern about the ability of the service to deliver the service with reduced numbers of staff.

UNISON members have expressed concern and disappointment that when Barnet Council Cabinet Committee agreed to the award the DRS contract to Capita on Monday 24 June 2013 they did so in the knowledge that this was a contract which would grow and there would not be any redundancies.

As members have pointed out in Table 7.1 DRS Staff Numbers

of the report the Highways Teams are down to increase not decrease.

Update

Last week the Trade Unions were informed that Capita Re would be extending the consultation period. The reason being Capita Re had been summoned to attend the Environment Committee members briefing on 2 October at 7 pm Hendon Town Hall.

UNISON will be attending the above meeting in order to find out if there are any proposals which may mean the redundancy proposals will be withdrawn.
